1. Agreement

These Terms of Service (“Terms”) govern your access to and use of PunchCheck, operated by PunchCheck (“we”, “us”). By creating an account or using the service you agree to these Terms and our Privacy Policy.

2. The service

PunchCheck lets you create digital inspection checklists, attach photos and signatures, link them to physical work sites, generate PDF reports, and share read-only links with third parties such as clients or insurers.

3. Your account

  • You must be 18 or older to use the service.
  • You're responsible for keeping your password confidential.
  • You're responsible for activity on your account and the accuracy of the data you record.
  • If you sign up on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or to violate the rights of others.
  • Upload content that infringes IP, defames, or invades privacy.
  • Attempt to disrupt or compromise the service's security.
  • Resell, sublicense, or repackage the service.
  • Submit false data into checklists, particularly where compliance or insurance reliance is foreseeable.

5. Your content

You retain ownership of the data you upload — your checklists, photos, signatures, site information, and so on. You grant us a limited licence to host, process, and display that data only as needed to operate the service for you (including transmitting it to people you choose via share links and email reminders).

6. Compliance disclaimer

PunchCheck is a tool for recording inspection data. It is not a substitute for the professional judgement of a qualified electrician, inspector, or compliance practitioner. We make no representation that any checklist, template, or output (including generated PDFs and bundles) satisfies a specific regulatory, statutory, or insurance requirement. You are responsible for ensuring that any checklist you complete or share is fit for the purpose you put it to.

7. Service availability

We aim to keep the service available, but we don't guarantee uptime. We may suspend or restrict access for maintenance, upgrades, or to address security issues. We may also change or discontinue features with reasonable notice.

8. Termination

You may close your account at any time from your profile page. We may suspend or terminate your account if you breach these Terms or if we're required to do so by law. On termination, your data is deleted as described in the Privacy Policy.

9. Disclaimer & liability

The service is provided “as is”without warranties of any kind, express or implied. To the fullest extent permitted by South African law, our total liability for any claim arising from your use of the service is limited to the greater of (a) the fees you paid us in the 12 months before the claim, or (b) ZAR 1,000.

We are not liable for indirect, incidental, special, or consequential damages — including lost profits, lost data, or insurance claims that depend on records held in the service.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the exclusive jurisdiction of the South African courts.

11. Changes to these Terms

We'll update these Terms from time to time. If a change is material, we'll ask you to re-accept on next sign-in. The date at the top of this page will always reflect the current version.
